By checking & signing this contract, you, referred to as "client" enter into the following agreement with Sarah Justice, referred to as “photographer.” This contract constitutes the entire agreement between both parties.
A. Session Fee: Client agrees to pay photographer the session fee is due prior to or at time of the session. The session fee covers the time and talent of the photographer, creative editing of images, as determined by the photographer and a digital proofing gallery.
B. Location Costs & Fees: If there are any costs/fees associated with the location the client has chosen for their session, the client will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. The creative fee covers travel within the local area of Jacksonville, FL (30 miles round trip). For travel beyond the 30-mile radius, a cost of $1/per mile will be added to the session fee. Locations beyond 60 miles (round trip) will be subject to additional fees to cover photographer’s time.
C. Rescheduling: If an illness or situation prevents a photo session from taking place, the client may reschedule their session at least 24 hours prior to their shoot without penalty. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
D. Proofing: Proofs of client’s images will be available for viewing within 7-10 days of session date in a protected web-gallery. Galleries will remain active for 45 days before expiring. Please make sure you use the “Download All” button before expiration and back up files on several hard drives. I do not store old files locally or make any guarantee that I will have them if you should need them. In the event, I do have them and able to resend, there is a $50.00 fee to do so per session. NO TANGIBLE PERSONAL PROPERTY IS TRANSFERRED TO THE CUSTOMER IN THIS CONTRACT.
E. Ordering: Client may place add-on orders or special retouching requests through e-mail or during a post-session consultation with the photographer. Prints may be ordered through the online gallery.
F. Payment: All payments are due in full unless payment arrangements have been made. Orders will not be processed until full payment is received. Due to the custom nature of each session, all sales are final.
G. Exhibition: Photographer shall only make reproductions for their portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, website, blog, editorial use, or for display within or on the outside of the photographer’s studio. If the photographer desires other uses, the photographer shall not do so without first obtaining the written permission of the client. Images of a personal nature, showing provocative posing or nudity, will only be showcased with exclusive written permission.
H. Copyright: Photographer retains all copyrights to all images created during client’s session. A print release is included with digital files to print portraits for personal use.
I. Client Usage: Upon final payment, the client has personal usage permission. Personal use permission is included with all high-resolution digital files, with which the owner may make prints for personal use and sharing, as well as use for their personal/professional advertising, blogs, sites, and social networks. Altering or editing photographs is prohibited. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from the photographer. A credit line, which reads “Sarah Justice” in type no smaller than that of the related text, must appear adjacent to or within all permitted published photographs.
J. Limited Liability: If the photographer cannot perform this agreement in whole or part due to a cause beyond the control of the parties, (such as illness or injury), then the photographer will return all fees to the client but shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. Photographer will not be held liable for any injuries incurred during the photography session.
